This Privacy Policy explains how AquaAether (Pty) Ltd (“AquaAether”, “we”, “us” or “our”) collects, uses and protects personal information when you visit our website or contact us.
Who we are
AquaAether (Pty) Ltd is a South African company based in Cape Town. We are the responsible party for the personal information described here under the Protection of Personal Information Act, 2013 (POPIA). For privacy questions, write to hello@aquaaether.com.
Information we collect
Information you give us. When you use the contact form, we collect what you enter: your name, organisation, email address, role, the option you choose under “I am a”, and your message. We also collect anything you send us by email.
Technical and hosting data. Our website runs on Cloudflare. To deliver the site, Cloudflare may process technical information such as IP addresses, browser type, device information and request logs, for security, performance and reliability.
Analytics. [If Cloudflare Web Analytics is switched on:] We use Cloudflare Web Analytics to understand how visitors use the site, such as page views, referrers and general traffic patterns. In its standard setup it does not use cookies to track individual visitors across sites. If we add other analytics tools, we will update this policy first.
How we use your information
We use personal information to: reply to your enquiry and continue the conversation you started; send information you ask for, such as our investor briefing; operate, secure and improve the website; understand aggregate website use; and meet our legal obligations. We do not sell your personal information, and we will not add you to a mailing list without asking.
Legal basis
We process your information because you have given it to us voluntarily and consented to us using it to reply, because we have a legitimate interest in running our website and responding to business enquiries, or because the law requires it. For visitors in the United Kingdom or European Economic Area, these are the lawful bases of consent, legitimate interests and legal obligation.
Who we share it with
We share information only with service providers that help us run the business and the website: Cloudflare (hosting, security, analytics and form handling); Google (email and document storage for enquiries sent to hello@aquaaether.com); and professional advisers, such as lawyers or accountants, where reasonably needed. They may use it only for the purposes we set. We may also disclose information where the law requires it or to protect our rights, users or others.
International transfers
We and our service providers may process information in South Africa and in other countries where those providers operate. Where we transfer personal information outside South Africa, we take reasonable steps to make sure it is protected to a standard at least equal to POPIA.
How long we keep it
We keep enquiries and correspondence for as long as we need to respond and manage our relationship with you, and to meet legal, accounting or reporting requirements. After that we delete it or make it anonymous. Analytics data is kept in aggregate form under our provider’s settings.
Your rights
You may ask us what personal information we hold about you and ask us to correct or delete it. You may also object to our processing it or withdraw your consent at any time. Write to hello@aquaaether.com and we will reply within a reasonable time; we may need to confirm your identity first. If you are unhappy with how we have handled your information, you may complain to the Information Regulator of South Africa (inforegulator.org.za) or, outside South Africa, to your local data protection authority.
Security
We use reasonable technical and organisational measures to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Children
Our website is not aimed at children under 18, and we do not knowingly collect personal information from them.
Changes to this policy
We may update this policy from time to time. The “Last updated” date at the top will change when we do.
